Lawyers make successful fatal mesothelioma compensation claim for electrician
Our specialist lawyers have recently concluded an industrial disease claim for fatal malignant mesothelioma for £60,000 plus CRU benefits. The compensation claim was on behalf of Mr B who was born in 1920. In November 2005 he was diagnosed with malignant mesothelioma, he died a few weeks later. Mr B was exposed to asbestos as follows:-
i. Between 1946 and 1952 he was working as an electrician for Pastures Hospital in Derby. He was often working in service tunnels under the hospital which contained miles of asbestos lagged pipework in a confined space. He had to remove the asbestos lagged pipework in order to carry out his repairs and maintenance work.
ii. Between 1952 and 1956 when he worked for ICI
iii. Between 1956 and 1970 when he worked for British Gas in Derby
iv. Between 1980 and 1985 when he worked for the local council at their incinerator plant, which involved Mr B knocking asbestos lagging from metal pipework which had come in for recycling.
Mr B’s daughter instructed us to pursue to a claim in the Autumn 2007. Previous solicitors had not been willing to pursue the claim because there was no lifetime statement from Mr B and it had not been possible to track down any of his previous workmates. However, Mr B had spoken to his daughter and son in law about his employment and they were able to confirm the circumstances of exposure to asbestos. With this information we were able to pursue the mesothelioma claim and the case settled for £60,000 plus CRU benefits. General damages for pain, suffering and loss of amenity were at the bottom of the scale of awards, because of Mr B’s age, and the fact that he had many other health difficulties.
