£155k for family of draftsman at Rolls Royce who died of mesothelioma
In 2006 leading industrial disease lawyer Linda Fletcher was instructed by the wife of Mr G to pursue a compensation claim for damages for mesothelioma. Mr G had sadly died in 2004 having contracted mesothelioma following asbestos exposure during his time working for Rolls Royce in Derby.
This case had previously been handled by another firm who were unable to locate the necessary evidence.
Mr G was a draftsman with the company and was responsible for investigating, recording and discussing problems with engineers and installation personnel. He was required to visit the test beds where he was exposed to asbestos dust.
The asbestos in the test beds was used for insulation purposes and the hot fuel and oil systems were also lagged with asbestos. Even the exhaust silencer system was covered in asbestos lagging in an effort to reduce the noise level.
Boyes Turner's specialist lawyers managed to locate a vital witness who was able to provide evidence regarding Mr G’s level of exposure and the details of his working practices whilst at Rolls Royce. He provided conclusive evidence about the level of exposure to asbestos dust, even commenting that asbestos had been found in the drawing office itself at one time.
Asbestos had been disturbed during refurbishment work which had meant that the dangerous fibres had been released into the air endangering the staff in the nearby area.
Given the Defendant’s reluctance to admit liability we issued proceedings following which the industrial disease claim settled in April 2008 for £155k (settlement net of benefits received and payment under the Pneumoconiosis Workers Compensation Act).
