Compensation awarded for mesothelioma claim - Boiler Room

Our specialist industrial disease lawyers recently settled a claim for 80 year old Mr L who suffers from mesothelioma – an asbestos related cancer.

With the exception of his National Service Mr L worked for the Long Eaton Co-operative Society as a plumbing and heating engineer where his duties were wide ranging, but to a large extent his work invloved working in the old boiler houses, all of which were insulated with asbestos which was about 6 inches thick. Mr L both chipped off the old decomposing asbestos and mixed the new asbestos to apply after remedial work had been done. Mr L indicates that the worst location for exposure was the Co-op bakery and the next worst was the dairy. 

He recalls that the troughs in the fields for the cattle who supplied the milk to the Co-op were actually made of asbestos as were the sheds in which the cattle were kept. He frequently worked in a cloud of asbestos and was provided with no mask, no extraction and no ventilation.

He also recalls working in the stables which housed the horses for the Co-op. There was asbestos sheeting on the walls which was simply whitewashed. As the horses came and went, they kicked the walls and asbestos fibres would be realised into the air.

He started to feel unwell about two years ago and was eventually diagnosed as suffering from mesothelioma in May 2006. Up until his diagnosis, he had been fit and active and enjoyed his garden, winning many prizes for his chrysanthemums.

In February of this year we obtained a medical report from our Consultant Chest Physician indicating that, at that time, Mr L was predicted to have a life expectancy of less than 6 months.

Mr Lawton is a widower with a grown up family. His industrial disease claim has settled for £81,700. £60,000 of which reflects his pain, suffering and loss of amenity.
