£80,000 compensation for mesothelioma claim - washing overalls

Our specialist lawyers acted for Mrs C, the daughter of Mrs R who died in April 2004. Mrs R was exposed to asbestos as a result of washing her husband’s work clothes in the 1960s and 1970s and died of malignant mesothelioma in April 2004. Mrs C asked us to act for her in January 2007 to pursue a compensation claim. There was no direct witness evidence, as Mr R had also died. However, Mrs C was able to produce newspaper reports dating from the time of her mother’s death confirming that her father had said at that stage that he thought the asbestos had come from his wife washing his clothes as he had been working in the construction industry. Mr R had worked for one employer throughout until the mid 1970s and we were able to track down a fellow employee who had also died as a result of mesothelioma.

Court proceedings were issued in April 2007 to protect the Claimant’s position according to limitation, and was served as soon as medical evidence was obtained in July 2007.

The industrial disease claim was concluded on 1 October 2007 in the sum of £80,000.
