Pleural plaques victims are one step nearer to justice
On Friday 14 October 2009 The Damages (Asbestos Related Conditions) Bill passed through the House of Commons. If it becomes law it will overturn the 2007 Law Lords Ruling denying compensation payments to sufferers of pleural plaques (scarring of the lungs following exposure to asbestos).
The Bill now passes to the House of Lords. If it succeeds there, hopefully it will become law in the very near future.
Helen Childs, a specialist industrial disease lawyer at Reading law firm Boyes Turner said: “It is very welcome news that the pleural plaques bill has been passed through the House of Commons. Hopefully it will become law in the very near future. It offers some hope to the many thousands of people who are living with the knowledge that their lungs are scarred because of their past exposure to asbestos and that they are at an increased risk of developing very serious asbestos related illnesses. If this bill becomes law it will allow those people to receive a Judgment – typically against their ex-employers – and some financial compensation. It will also give them the peace of mind knowing that if their condition did deteriorate they and their families wouldn’t then have to do battle with the Defendants to establish liability to pay damages.”
